Public feedback sought on temporary youth bail laws

Public comment is open on a temporary bail test applying to some young people in NSW, with a statutory review now underway.

The Department of Communities and Justice is seeking feedback on section 22C of the Bail Act 2013 on behalf of the Attorney General, ahead of the law’s scheduled expiry later this year.

Section 22C introduced an additional temporary bail test for young people aged 14 to 17 who are charged with motor vehicle theft, serious break and enter, or a performance crime, while already on bail for a similar offence.

The provision has been in place since April 2024 and is legislated to remain until October 1, 2026, unless changed or extended following the review.

The department has released a consultation paper outlining the background, policy objectives and operation of the temporary bail test.
